JustOG — Creator Terms

These Creator Terms ("Creator Terms") govern listing your designs for sale on JustOG and earning from them. They supplement, and are part of, the Terms of Service, Acceptable Use & Content Policy, and DMCA / Copyright Policy, each incorporated by reference. Capitalized terms not defined here have the meaning given in the Terms of Service.

By listing a design for sale (clicking "List for sale"), you accept these Creator Terms. If you do not agree, do not list your designs — you can still create and buy for your own use.


1. What "listing" means

1.1 When you list a design, you make it available for other users to buy as a made-to-order product that JustOG produces and fulfils. You are the "Creator" of that design. 1.2 Listing is optional and applies only to the specific designs you choose to list.

2. You keep ownership — you grant us a license

2.1 You retain all ownership of your design. These Creator Terms are a license, not an assignment or transfer of your copyright. 2.2 For each design you list, you grant JustOG a worldwide, royalty-bearing, non-exclusive license to reproduce the design; to adapt it as reasonably necessary to place, size, colour-match, and mock it up on a product; and to produce, display, market, distribute, and sell products bearing the design. This license covers JustOG's current and future made-to-order products of a similar nature (e.g. additional garments or goods), so we may offer the same design on more than one product. You earn the same royalty on every sale regardless of which product sells. 2.3 The license lasts while the design is listed, plus a short tail period reasonably needed to fulfil orders already placed and to keep business, legal, and financial records. 2.4 This license is non-exclusive: you keep the right to use your design elsewhere. 2.5 AI-generated designs. You acknowledge that, under current U.S. Copyright Office guidance and law, a design created by an AI model may have limited or no copyright protection to the extent it lacks sufficient human authorship. You grant under this Section 2 only the rights, if any, that you actually hold, and nothing here is a representation by you or JustOG that a design is protectable by copyright. This does not reduce your obligations in Section 4 — regardless of how a design was made, you must not list one that infringes or misuses any third party's rights. 2.6 No guarantee of exclusivity. Because AI-generated designs can be easily reproduced or independently re-created, JustOG does not warrant that your design is exclusive, or that other users will not create, list, or sell similar or identical designs. You are not entitled to exclusivity. Your royalties are earned on the sales JustOG makes of your listing (Section 5), not on ownership of the underlying design.

3. What JustOG controls

3.1 JustOG sets retail prices, selects which products a design is offered on, and decides how designs are presented, curated, featured (including in drops), and advertised. These are our commercial decisions. 3.2 We are not obligated to list, keep listing, produce, or advertise any design, and we may decline or remove listings under Section 7.

4. Your promises

4.1 You represent and warrant that you own or have all rights necessary to grant the license in Section 2, and that the design does not infringe or violate any third party's intellectual-property, publicity, privacy, or other rights, and complies with the Acceptable Use & Content Policy. 4.2 You will indemnify JustOG as set out in the Terms of Service for claims arising from your design or your breach of these Creator Terms.

5. How you earn (royalties)

5.1 For each qualifying sale of your listed design, you earn a royalty equal to a percentage of the list retail price — the product's listed price at the time of the sale, before any discount, promotion code, or other price reduction, and excluding shipping and taxes — subject to a per-unit cap (so that price premium attributable to JustOG's brand, merchandising, or product tier stays with JustOG). The current rate and cap are shown in the app and may be updated prospectively; the rate and cap in effect at the time of a sale are recorded with that sale and are not changed retroactively. 5.2 Earnings accrue to a ledger and become payable after a hold period (currently 30 days) that covers refunds and returns. Earnings that are refunded, charged back, or tied to a design that is taken down for policy or infringement reasons are reversed and are not payable. 5.3 Payouts are made once your cleared balance reaches the minimum payout threshold shown in the app (currently $25); amounts below the threshold carry forward. Payouts are processed on a periodic basis. 5.4 To be paid, you must complete any required identity and tax onboarding (for U.S. persons, a Form W-9) through our payments provider, which may withhold or report amounts (e.g. Form 1099) as required by law. You are responsible for taxes on your earnings. 5.5 You do not earn a royalty on a sale you make of your own listing, or on any design flagged as in-house/official. 5.6 We do not guarantee any sales or earnings. 5.7 Discounts and promotions do not reduce your royalty. JustOG may run sales, discounts, and promotion codes at its discretion (Section 3.1), and JustOG funds them: your royalty is calculated on the list retail price under Section 5.1, not on the discounted amount a buyer actually pays. You are not asked to contribute to a promotion, and there is nothing for you to opt into or out of — because you do not set prices or run campaigns, a promotion is our decision and our cost.

6. You can unlist

6.1 You may unlist a design at any time. Unlisting stops new sales; orders already placed will still be produced and shipped, and completed sales are not reversed. You keep royalties already earned (subject to Section 5). 6.2 To protect active marketing (e.g. a live ad campaign pointing at a listing's page), a voluntary unlist request may be honoured within a short wind-down window rather than instantly. A design you believe infringes or violates policy will be removed promptly on request — see Section 7.

7. Removal by JustOG

7.1 We may immediately remove or disable a design and its listings for any violation of the Terms of Service, this or any policy, a valid infringement or takedown notice, or applicable law. Removal for infringement reverses related accrued earnings. 7.2 Repeat infringers are terminated under the DMCA / Copyright Policy.

8. Moral rights

To the extent permitted by law, you waive, and agree not to assert, any moral rights or rights of attribution/integrity in the design as used under the license in Section 2.

9. Relationship

You act as an independent creator. Nothing here creates an employment, agency, partnership, or joint venture relationship, and listing designs does not entitle you to any benefits.

10. Changes; general

We may update these Creator Terms prospectively; material changes will be notified as required. These Creator Terms are governed by, and form part of, the Terms of Service (including its governing law, dispute-resolution, disclaimer, and limitation-of-liability sections).
